Republicans, led by Senator Ted Cruz and Representative Andy Ogles, have introduced legislation aimed at providing legal protections to individuals who choose not to use specific names or pronouns, with a particular focus on federal employees.
A Legislative Shield Against Pronoun Mandates
The Safeguarding Honest Speech Act, introduced in both the House and Senate, seeks to shield individuals from disciplinary action for misgendering or misnaming someone, allowing them to sue federal officials for up to $100,000.
DHHS Directive on Pronouns Sparks Republican Response
The bill was introduced in response to a directive from the Department of Health and Human Services (DHHS) in October, which instructed employees to use names and pronouns chosen by individuals.
Republican Critique
This directive, viewed by Republicans as part of so-called “woke” LGBTQ+-inclusive policies, prompted the introduction of the Safeguarding Honest Speech Act.
Alejandra Caraballo’s Observation
American civil rights lawyer Alejandra Caraballo raised a concern regarding the bill.
Name vs. Nickname
The bill would mandate individuals to use Sen. Cruz’s legal first name, Rafael, instead of his commonly used nickname, Ted.
The bill explicitly prohibits measures that mandate certain employees to use pronouns different from a person’s biological sex or a name other than their legal name.
Unconstitutional Violation of the First Amendment
Sen. Cruz defended the bill, stating, “Forcing anyone to use pronouns that don’t accord with a person’s biological sex is an unconstitutional violation of the First Amendment.”
He argued that the government has no authority to compel the use of pronouns contradicting biological reality.
Rep. Ogles’ Concerns
Rep. Ogles expressed similar concerns to Sen. Cruz, particularly regarding potential job repercussions for individuals not using ‘preferred pronouns.’
He criticized the Biden administration, asserting that it is coercing speech in pursuit of what he called a “delusional woke agenda.”
Imposing “Radical Gender Ideologies”
Rep. Lauren Boebert, a co-sponsor of the bill, accused the DHHS of ‘imposing radical gender ideologies.’
She has previously expressed concerns about affirming trans people’s identities.
Requiring Correct Names and Pronouns Exacerbates Divisions
Rep. Paul Gosar argued that mandating federal employees to use correct names and pronouns could further divide the American people.
Anti-LGBTQ+ Groups Back the Legislation
The legislation has received support from groups that have previously advocated against LGBTQ+ rights and inclusivity, such as Concerned Women for America and CatholicVote.
Admiral Rachel Levine’s Defense
In response to the proposed bill, Assistant Secretary for Health Admiral Rachel Levine, an openly transgender woman, defended the DHHS policy.
Correct Names and Pronouns for Workplace Equality
She emphasized that ensuring the use of correct names and pronouns provides equal workplace protections for all employees, including transgender and nonbinary individuals.
Workplace Discrimination Statistics
Statistics reveal the prevalence of workplace discrimination against transgender individuals, with over 75% experiencing some form of discrimination, including deliberate misgendering, according to the National Center for Transgender Equality.
Williams Institute Report
The Williams Institute reports that transgender employees are significantly more likely to face discrimination based on their LGBT status, including verbal and physical harassment, compared to cisgender LGB employees.
Controversial Bill Sparks Ongoing LGBTQ+ Rights Debate
As this controversial bill makes its way through Congress, the debate over the rights of individuals to use or refuse specific names and pronouns continues to be a focal point in the ongoing discourse surrounding LGBTQ+ rights and protections in the United States.
The coming weeks will likely see increased scrutiny and discussions surrounding these proposals.
